“Most people think that their insurance cover them if they get sued,” said Kimbrough, an attorney and the founder of Kimbrough Law. “Even the biggest auto, homeowners, or umbrella liability coverage won’t be enough to satisfy a large judgment. They’ll take your home, your car, your rental properties, and your life savings.”
Kimbrough cautions that asset protection planning is about more than just being prepared for potential lawsuits. “Without the right planning, you can lose your assets to predators, creditors, the nursing home, and even Uncle Sam,” he explained. “For instance, most people don’t realize that giving assets to family members can cause unintended problems, including hefty capital gains tax bills and delays in Medicaid applications. These mistakes are 100 percent avoidable with the right planning.”
